TERMS OF USE
Effective: 4 September 2026
1. Provider and scope
These terms apply to THE HOME OF PACEMAKERS (THOP), operated by Marcel Saluz, Lenggenbachstrasse 2d, 8951 Fahrweid, Switzerland.
Contact: info@thop.run
2. Platform and user account
THOP provides functions for pacemakers, runners and organizers. A personal account is required for protected areas. Login details must not be shared with third parties.
Users are responsible for the accuracy of their information and for content they publish or submit on THOP.
3. THOP Academy
An Academy purchase includes the stated access to learning modules, the final examination and, after passing, the certificate. The standard completion period is 90 days from activation.
The final examination consists of 20 questions in 20 minutes and requires 80 percent to pass. After a failed attempt, a retake is available after 24 hours at the earliest. A passed examination cannot be retaken.
4. Certification
Certification confirms successful completion of the THOP Academy. Certificate numbers are personal and unique and must not be misused or assigned to another person.
THOP may review and, where objectively justified, suspend or revoke certificates in cases of proven misuse, manipulation or serious false information.
5. Memberships
Free Profile, Certified Pacemaker and THOP Full Access differ according to the current feature overview. Paid memberships normally run for one year and renew automatically for another year unless cancelled before renewal.
Cancellation takes effect at the end of the current period. Full access remains available until then. Certification status and certificate are unaffected by a downgrade to the Free Profile.
6. Prices and payment
The price displayed in Swiss francs before purchase is binding. Payments are processed via Stripe. Available payment methods are shown at checkout.
Information and prices can be reviewed and corrected before payment. Access is confirmed electronically after successful payment.
7. Refunds and withdrawal
Swiss law does not provide a general right of withdrawal for ordinary online purchases. Unless mandatory law provides otherwise, there is generally no right to a refund once digital learning content has been activated and used.
Incorrect bookings, technical problems or exceptional hardship may be reported promptly to info@thop.run and will be reviewed individually.
8. Conduct and content
Illegal, offensive, discriminatory, deceptive or unsafe content, identity misuse, unauthorized advertising and manipulation attempts are prohibited.
THOP may review, hide or remove content and restrict accounts for serious or repeated violations.
9. Responsibility and liability
THOP supports education, networking and introductions but does not guarantee assignments, athletic performance, target times or suitability for a particular race.
Sporting information is used at the user’s own responsibility. Medical advice should be sought for health questions. Otherwise, liability is governed by applicable Swiss law.
10. Race calendar and third-party events
Clubs and other organizers may list their races and accept registrations through the THOP race calendar. THOP only provides the technical platform and is not the organizer, operator or co-organizer of listed events.
The respective organizer is solely responsible for planning, organization, delivery, cancellation, safety, permits and required insurance and expressly confirms this when creating an event.
Participation in an event listed or arranged through THOP is at the participant’s own risk. THOP gives no guarantee that an event will take place or that organizer information is complete or correct.
To the extent permitted by law, THOP excludes liability for damage connected with a listed event. Claims concerning an event must be directed to its organizer.
11. Privacy and amendments
Information about data processing is provided in the Privacy Policy.
THOP may amend these terms for objective reasons. Material changes affecting current paid contracts will be communicated appropriately.
12. Applicable law
Swiss law applies. Mandatory statutory places of jurisdiction remain reserved.
